DMCA Notice & Takedown Procedure
Drexown Ventures LLC respects the intellectual property rights of others and expects its visitors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, the text below describes how to submit a notice of claimed copyright infringement.
1. Designated agent
[DRAFT — pending counsel] Drexown Ventures LLC has designated an agent to receive notifications of claimed infringement. To be effective under 17 U.S.C. § 512(c)(2), this designation must be filed with the U.S. Copyright Office; the filing is the founder’s responsibility (seeCHECKLIST.md, item “DMCA registration”).
- Designated agent name: [DRAFT — pending counsel]
- Email: dmca@drexownventures.com
- Postal address: Drexown Ventures LLC, Attn: DMCA Agent, 30 N Gould St, Sheridan, WY 82801
2. What to include in your notice
[DRAFT — pending counsel] Under 17 U.S.C. § 512(c)(3), a valid notification of claimed infringement must include the following:
- A physical or electronic signature of the rights holder or an authorized agent.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works at a single online location).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (a specific URL is required; a general site-wide statement is not sufficient).
- Contact information: address, telephone number, and email address of the complaining party.
- A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
3. What we will do on receipt
[DRAFT — pending counsel] We will review each complete notice and, where appropriate, remove or disable access to the allegedly infringing material, and attempt to notify the user who posted the material. We may also terminate the accounts of repeat infringers in appropriate circumstances.
4. Counter-notification
[DRAFT — pending counsel] If you believe that material you posted was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the owner’s agent, or pursuant to law, to post and use the material, you may send us a counter-notice containing the six elements required by 17 U.S.C. § 512(g)(3). We will forward the counter-notice to the original complaining party and may restore the removed material in accordance with the DMCA.
5. Misrepresentations
[DRAFT — pending counsel] Be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
